New service tax rate of 14% to come into effect from June 1, 2015

We would like to inform you that as per Central Government in India has finally announced New service tax rate of 14% to come into effect from June 1, 2015.

The service tax is currently levied at the rate 12.36 per cent including education cess. We will be implementing new service tax rates on 01 June 2015 in our billing system. Invoices from 01 June 2015 onward will carry service tax rate of 14%  for rail and air freight billings and 3.50% for the surface mode transportation billing as per Govt. notification.

Customs Offices in Nepal with MAP

There are 31 main Customs offices in all over the country (Including one at Tribhuvan International Airport) under the direct supervision of the department and 143 sub-customs offices under the supervision of main customs offices. Since Nepal is a land locked country, she does not have sea port customs. International Airport customs is headed by chief customs administrator of joint secretary level where as the other main customs offices are headed by either Chief Customs Officer of under-secretary level or Customs Officer and sub-customs offices by Customs Inspectors. The number of customs officers and sub-ordinate staffs in a customs office will vary with the volume of transaction. Altogether, there are 1273 employees under the department. The role of customs in total tax collection is significant. It contributes about one third to the total tax revenue of the government. Considering the facts about volume of transaction, the customs offices will remain open longer than office hours if necessary, to facilitate the movement of people and trade.

Vehicle Permit - In Nepal

Although there is a large movement of cross border vehicular traffic between India and Nepal, there is no bilateral Motor Vehicle Agreement. Motor vehicle movement between the two countries is allowed on the basis of understanding reached between the two governments in 1960s, which continues till date. The details of the present arrangements are as follows:

1. Nepal registered vehicles

1. Nepali vehicles, including two wheelers, have free cross border access to the nearest municipal town/market place or railhead in India provided the vehicle returns to Nepal on the same day. No permit is required nor any levy or tax payable for such visits.
2. For Nepali vehicles going to the interior parts of India (i.e. beyond the nearest market place or railhead) or for vehicles staying in India for more than a day i.e. night halt, the owners of the vehicles are required to obtain a "Vehicle Permit" from the Embassy of India, Kathmandu or Consulate General of India, Birgunj or the Camp Office of the Embassy at Biratnagar. (The CDOs or other officers of Government of Nepal are not authorized to issue these permits).
3. Vehicle permits are issued on payment of specified fees and completion of prescribed formalities including submission of a bank guarantee of the requisite amount.  The vehicle permits can be obtained for a maximum validity of 3 or 6 months and for single/double/multiple entries. The 'Permits' are required to be stamped by the Indian Border Check Post both on entering and exiting the Indian territory. 
4. The Consulate General of India, Birgunj issues vehicle permits in respect of vehicles falling under the 8 districts of its consular jurisdiction namely, Parsa, Bara, Makawanpur, Chitwan, Rautahat, Sarlahi, Mahottari and Dhanusha and registered either with Narayani or Janakpur Zonal Transport Office. Accordingly, only the vehicles having registration number with prefix 'Na' and 'Ja' are advised to approach the Consulate General of India, Birgunj, for issue of vehicle permits. Applications can be made on any working day between 0930-1230 hrs. The permits are normally issued within 3 working days. The relevant forms/details can be downloaded from the list below:

2. Indian registered vehicles

1. Indian vehicles, including two wheelers, can visit the nearest municipal area/market in Nepal for day long visits (return to India on the same day) without payment of any levy or tax. However, the vehicle owners are required to register the vehicle at the Nepalese border check post and obtain a Pass/Challan which has to be compulsorily returned to the Nepal customs authorities while returning back to India.
2. The Indian vehicles going beyond the nearest Nepali town or staying overnight in the bordering districts of Nepal are required to register the entry of vehicles for the specific number of days on payment of charges varying from NRs. 250/- to 500/- per day depending on the type of vehicle. The Pass/Challan issued by the Nepali Custom Authorities should be available for inspection all the time and has to be surrendered to the Nepali customs authorities at the time of exit from Nepal. 
3. If the Indian vehicle enters Nepal on day ‘Pass’, it must return to India the same day. Similarly, the vehicles with ‘Pass’ for specific duration must exit Nepal before the expiry of the 'Pass' date and then re-enter on a new 'Pass'. If due to any exigency the vehicle has to overstay in Nepal, the vehicle owner should approach the nearest Nepalese Customs Office (Bhansar) or the Police Authorities for extension of period of the 'Pass'. The extension must be sought within the validity period of the initial permission/'Pass'.
4. Indian vehicles cannot be retained in Nepal for more than one month even on payment of charges.
5. Indian vehicles found in Nepali territory without the said entry ‘Pass’ are treated as illegally smuggled into Nepal and these are seized by the police and later auctioned by the Nepali customs authorities. Such stringent measure from the Nepali side is to curb smuggling of stolen Indian vehicles in Nepal as well as the unauthorized commercial use of Indian vehicles in Nepal (The very high customs import duty on vehicles in Nepal tends to encourage smuggling of stolen Indian vehicles in Nepal as well as commercial use of Indian vehicles in Nepal).

Tribhuvan International Airport (TIA) is the only gateway to Kathmandu for the tourists who come by air. The Airport named after King Tribhuvan, the 8th Shah King of Nepal, is situated about 4.5 miles east of the city (about 25 minutes drive). TIA is also in between all the three major cities of Kathmandu Valley namely Kathmandu, Bhaktapur and Patan. Facilities of bank, duty free shop, restaurants and tourist information center is available at TIA.

Kakarbhitta, Jhapa is about 15-17 hours drive and 610 kilometers away from Kathmandu. This is a small town on the border between Nepal and India and foreigners can use this to cross the border. There are many hotels and lodges around the area to accommodate the tourists in moderate prices. Tourists can commute to Kathmandu or any other cities either by bus or air. The closest airport is at Bhadrapur, about 25km southwest of Kakarbhitta and it takes about 3 and half hours to land in Kathmandu domestic airport by flight.

Birgunj is the main entry point to Nepal for Indian tourists especially coming from Calcutta and Patna. Birgunj which is about 210 kilometers away from Kathmandu is also an important entry point for foreign goods to Nepal. Lots of tourists enjoy sightseeing in this flat land and low altitude city as well as the accommodation of varied choices. Birgunj has a railway to Raxaul. The nearest airport is in Simara which is about 20 km from Birgunj and it takes about 20 minutes to reach Kathmandu by air.

Kodari, about 6/7 hours drive from Kathmandu lies on the Nepal-China border. This border is still regarded as an important trading center between Nepal and Tibet. Apart from all this, Kodari is very famous for its magnificent rivers gorges and splendid scenes of mountains. The very famous hot water spring of Nepal called Tatopani is also very close to Kodari. There are quite few places to lodge in this area and regular buses are available to commute to Kathmandu.

Belhia, Bhairahawa which is also known as Siddharthanagar is about 8-9 hours drive and 280 kilometers away from Kathmandu. This city being close to the border of India is another important city in Nepal from the import and export business aspect. Bhairahawa is also the gateway to Lumbini, the birth place of Lord Buddha. This place is also quite popular for shopping Chinese goods. It takes about 30 minutes to reach Kathmandu from Bhairahawa via plane and other local bus services are also available to travel to and from Kathmandu.

Jamunaha, Nepalgunj is about 12-13 hours drive and 530 kilometers away from Kathmandu. There are direct flights between Kathmandu and Nepalgunj everyday and the buses are also easily available. Nepalgunj is also one of the major trading centers of Nepal and it lies near the Indian border and well connected to all major Indian cities by road and railways.

Mohana, Dhangadhi which lies in far western region of Nepal is about 660 kilometers away from Kathmandu. Although this place does not have much to offer, it is used as an entry and exit point to and from Kathmandu mostly by the Indian tourists as the capital of India, New Delhi is just about 6 hours drive. Dhangadhi is also facilitated by decent stay in places in fairly cheap prices. 91/21205) is in the bazaar.

Gadda Chauki, Mahendranagar is a small town that lies in the far western region of Nepal. It is about 18-19 hours drive and 695 kilometers away from Kathmandu. There are some good hotels and lodges for accommodation. A visit to Royal Bardia National Park can be arranged while in Mahendranagar.

Shipping Bill/Bill of Export-This is the main document required by the Customs Authority for allowing shipment, Basically, shipping bills are of four types. The major distinction between on type and another Shipping Bill lies with regard to the goods being subject to certain conditions: export duty/cess, free of duty/cess, entitlement of duty drawback, entitlement of credit of duty under DEPB Scheme and re-export of imported goods.

The documents required for processing of Shipping Bill are as follows:

• GR forms in duplicate for shipment to all countries 
• 4 copies of packing list giving contents, quantity, gross and net weight of each package.
• 4 copies of invoices indicating all relevant particulars such as No. of packages, quantity, unit rate, total f.o.b./c.i.f. value, correct and full description of goods etc. 
• Contract, L/C, Purchase Order of the overseas buyer 
• AR4(Original and duplicate) and invoice 
• Inspection/Examination Certificate 

The formats presented for the shipping bill are as under: White shipping bill for export of duty free of goods prepared in triplicate Green shipping bill for export of goods under claim for duty drawback prepared in quadruplicate Yellow shipping bill for export of dutiable goods prepared in triplicate. Drawback on Exports by Surface (Land) to Nepal, Bhutan and Myanamar

Drawback on exports to Nepal, Bhutan and Myanmar (Burma) by land shall be admissible on the following terms and conditions.

There are three different policies for drawback against exports to these countries. These are –

(i) exports against an irrevocable letter of credit established by Nepalese, Bhutanese or Burmese importers of any items to any person,

(ii) supplies to projects in Nepal or Bhutan financed by UN, World Bank IDA or ADB or any other multilateral agency but for which payment is received in any freely convertible currency.

(iii) capital goods exports to Nepal against global tender for which payment is received in Indian currency.

Payment for Exports

Nepal, Bhutan, Myanmar. Drawback will be admissible against export to Nepal, Bhutan and Myanmar, provided an irrevocable Letter of Credit (L/C) in freely convertible currency is established by the Nepalese, Bhutanese or Burmese importers in favour of Indian exporters for the value of export goods.

Nepal and Bhutan. It shall also be available against supplies to projects in Nepal/Bhutan financed by any United Nations Agency or the International Bank for Re-construction and Development (IBRD) or the International Development Associations (IDA) or the Asian Development Bank (ADB) or any other multilateral agency of the like and for which payment is received in freely convertible currency.

Global Tender

If capital goods i.e. items of machinery including prime movers, instruments, apparatus and appliances, control gear and transmission equipment as well as auxiliary equipment (including those required for research and development purposes, testing and quality control), required by an importer for production of goods or for rendering services including those for replacement or expansion, are exported under claim of drawback to any place in Nepal against any global tender invited by Nepal and for which payment is received in Indian currency, such items will also be eligible to drawback.

Bank Certificate

The exporter is required to produce a certificate duly signed by the concerned bank in India showing the payment in freely convertible currency or, as the case may be, in Indian currency.

Land Routes

Where the exports take place through Land Customs Stations, such exports shall be through the following Land Customs Stations.

Nepal

1. Jogbani
2. Nautanawa
3. Raxaul

Myanamar

4. Darranga
5. Jaigaon
6. Imphal-Pallel-Taruk Road (NH-39)
7. Ledo-Tirap-Manpong Pangsu Pass Road

FOB Value

For exports undertaken from various Land Customs Stations, the f.o.b. value will be taken to include the cost of transportation from the point of loading of export goods, any where in India, upto the Land Customs Station from which export is being effected. The cost of international transportation beyond the Indian Land Customs Station, into the neighbouring country will be excluded from the f.o.b. value.

Export Procedure

For export by land (or by air) to any destination, in Nepal, Bhutan and Myanamar, the exporter should present a Bill of Export (B. Ex.) to the Superintendent at the Land Customs Station. Along with the Bill of Export, the following additional documents are to be submitted in case of exports to Nepal/Bhutan/Myanamar:

(i) export i.e. commercial invoice,

(ii) packing list/weight specification,

(iii) pre-shipment inspection certification where the goods are subject to such inspection,

(iv) Govt. of India’s letter (copy) where a brand rate has been fixed.

(v) Export licence/contract.

The following additional documents are to be submitted to the Commissioner of Customs (Preventive) Office, Patna (Bihar) after the completion of export to Nepal.

(i) bank certificate in the prescribed form for having received the specified amount of foreign exchange in US Dollars or UK Sterling Pounds,

(ii) invoice

(iii) evidence of the receipt of goods in Nepal/Bhutan/Myanamar.

While submitting these documents, the exporter should quote the relevant Bill of Export No. and date for necessary linking of documents relating to drawback claim.
